What can you do?
Employers are going to have to revise existing policies governing attendance, paid time off, calling off work and discipline. However, from the date voters approve the Act, or starting one month later when the Act takes effect (differences of opinion exist on this matter), employers would be prohibited from reducing any other kind of leave in order to shield themselves from the incremental costs of complying with the mandate. Employers also would be prohibited from considering employees' use of paid sick leave as "a negative factor in an employment action? of any kind, such as hiring, evaluation, promotion or disciplinary action. These provisions have great potential for costly litigation. Employers who are deemed to have violated the paid sick leave mandate would be liable for up to treble damages for wages and benefits lost, plus interest.

Employers would be prohibited from disclosing medical certification information to anyone other than the employee without the employee's express permission. This provision arguably could prevent an employer from telling co-workers or customers that an employee is home sick.
